Batter at bat gets "hit" by ball...

Batter at bat gets "hit" by ball...

Coach pitch (pinto) game. I was simply an observer. Kid at bat swings at ball, which slams down, hits plate, bounces high, kid makes run for first, ball comes down, hits batter on his back, which then goes foul. Ump calls foul. OK- for this level of play I see why he called it that way...but I called him aside afterwards and asked was that not an out? he stood by his call. My question: WAS the batter out?
Thoughts? :)

If the batter was still in the box, I believe it is a foul ball if it hits the batter, whether or not it bounces foul.

If the batter was not in the box (one foot has to hit the ground completely out of the box) then the position of the ball when it hit the batter determines the outcome. If the ball was over fair territory, then the batter is out. If the ball is over foul territory, it is a foul ball. This assumes the batter did not touch the ball intentionally.
